The Dunigan 5 Credit Comeback Giveaway ("Contest") is sponsored and administered by Dunigan Investment Group ("DIG" or "Sponsor").
By submitting an entry, each entrant acknowledges that he or she has read, understands, and agrees to be bound by these Official Rules & Terms and Conditions ("Official Rules").
The Contest is intended to identify five individuals who are committed to improving their credit profile and are willing to actively participate in a structured six-month credit-repair and credit-education process.
1. CONTEST PERIOD
The Contest begins:
Monday, August 31, 2026 at 12:00 a.m. Eastern Time
and ends:
Thursday, October 1, 2026 at 11:59 p.m. Eastern Time.
All required entry information, video submissions, acknowledgments, and consents must be received before the Contest closes.
Entries received after the deadline will not be considered.
Five potential winners are scheduled to be announced:
Friday, October 2, 2026 at approximately 8:00 p.m. Eastern Time
during a live announcement on platforms designated by Dunigan Investment Group, which may include Facebook Live, Instagram Live, or other official DIG platforms.
2. ELIGIBILITY
The Contest is open to legal residents of the fifty (50) United States and the District of Columbia who are twenty-five (25) years of age or older at the time of entry.
The Contest is void where prohibited or restricted by applicable law.
The following individuals are not eligible to enter or win:
- Employees of Dunigan Investment Group;
- Immediate family members of the owners or employees of Dunigan Investment Group;
- Members of the household of a DIG owner or employee;

For purposes of these Official Rules, "immediate family" includes a spouse, parent, child, sibling, grandparent, grandchild, and corresponding step- or in-law relationship.
Independent contractors of Dunigan Investment Group may enter provided that they otherwise satisfy all eligibility requirements.
A contractor who enters the Contest may not participate in judging, scoring, reviewing, administering, or otherwise influencing his or her own entry or the selection of winners.
DIG may require documentation necessary to verify eligibility before confirming a winner.
3. ONE ENTRY PER PERSON
Only one entry per person is permitted.
Only one Contest entry may be associated with each:
- Individual;
- Email address;
- Mobile telephone number; and
- Residential address.
Duplicate entries are prohibited.
An entrant may not attempt to obtain additional entries by using:
- Different email addresses;
- Alternative telephone numbers;
- Different spellings of a name;
- False names;
- Another person's identity;
- Alternative addresses;
- Automated submission systems;
- Bots;
- Multiple accounts; or
- Any other method intended to circumvent the one-entry limitation.
Duplicate or fraudulent entries may result in immediate disqualification of all entries associated with the entrant.
DIG reserves the right to compare entry information for purposes of detecting duplicate, fraudulent, manipulated, or otherwise improper entries.
4. HOW TO ENTER
To enter, an eligible individual must complete the official Dunigan 5 entry form during the Contest Period and provide all required information.
The application may request information including:
- First and last name;
- Email address;
- Mobile telephone number;
- Residential address;
- City and state;
- Credit-related goals;
- Information concerning how the entrant's current credit situation has affected his or her life or goals;
- Required acknowledgments;
- Agreement to these Official Rules; and
- A required video submission.
The information submitted must be accurate and truthful.
No purchase of any Dunigan Investment Group product or service is required to enter.
Purchasing a product or service will not increase an entrant's likelihood of being selected.
5. REQUIRED VIDEO SUBMISSION
Each entrant must submit a video explaining why he or she wants to become one of The Dunigan 5.
The purpose of the video is to allow applicants to communicate their story in their own words.
Entrants are encouraged to discuss:
- Their current credit situation;
- How credit challenges have affected their life;
- Why improving their credit is important;
- Goals that credit challenges have prevented or delayed;
- What a credit comeback would mean to them;
- Why they are prepared to make changes;
- Their willingness to commit to the six-month program;
- Their financial or personal goals; and
- Why they believe they should be selected.
The story must be truthful and based upon the entrant's actual circumstances and experiences.
False, fabricated, materially misleading, or deceptive submissions may result in disqualification.
6. VIDEO CONTENT REQUIREMENTS
Entrants should preferably appear individually in their submitted videos.
Entrants are responsible for obtaining appropriate permission from any other identifiable individual intentionally included in a submission.
An entry video may not knowingly:
- Infringe another person's copyright, trademark, privacy, publicity, or other rights;
- Contain unlawfully obtained material;
- Contain materially false information;
- Impersonate another person; or
- Contain unlawful content.
Entrants should never display highly sensitive information in an entry video, including:
- Social Security numbers;
- Social Security cards;
- Driver's-license numbers;
- Bank-account numbers;
- Credit-card numbers;
- Full credit-report account numbers;
- Passwords;
- SmartCredit login credentials; or
- Other private financial credentials.
Sensitive documents required from selected winners will be collected separately.
7. VIDEO AND MEDIA CONSENT
By voluntarily submitting a video to the Contest, the entrant grants Dunigan Investment Group permission, subject to applicable law, to review and use the submitted video in connection with The Dunigan 5 campaign.
This permission includes the right to:
- Reproduce;
- Publish;
- Display;
- Repost;
- Distribute;
- Reasonably edit for length or formatting; and
- Otherwise use the submission.
The submission may be used in:
- The Dunigan 5 website or landing page;
- Dunigan Investment Group websites;
- Social-media accounts;
- Contest advertising;
- Promotional materials;
- Campaign updates;
- Winner announcements;
- Follow-up campaign content;
- Digital marketing; and
- Content documenting The Dunigan 5.
Entrants understand that their submission may be publicly displayed even if they are not selected as a winner.
DIG is not required to publish or use every submission received.
Reasonable editing may be performed for length, formatting, captions, platform compatibility, or presentation, but DIG will not knowingly edit a person's statement in a manner that materially misrepresents what the person said.
8. REQUIRED VIDEO CONSENT
The Contest entry page will require entrants to affirmatively acknowledge and consent to the public-use provisions associated with their video submission.
VIDEO SUBMISSION & MEDIA CONSENT
By checking this box and submitting my video, I confirm that I am at least 25 years old, that the information I provided is truthful, and that I voluntarily authorize Dunigan Investment Group to review, display, reproduce, publish, repost, and use my submitted video in connection with The Dunigan 5 Credit Comeback Giveaway, including on websites, landing pages, social media, advertising, promotional materials, and campaign-related content. I understand that my video may be publicly displayed whether or not I am selected as a winner. I understand that I should not include sensitive personal or financial information in my video.
The consent must be affirmatively accepted as part of the entry process.
9. JUDGED CONTEST — NO RANDOM DRAWING
The Dunigan 5 is a judged promotional contest.
Winners will not be selected through a random drawing.
Eligible submissions will be evaluated based upon the entrant's submitted application, video story, demonstrated commitment, goals, and the judging criteria contained in these Official Rules.
Having the lowest credit score, most debt, most negative accounts, greatest hardship, or any particular credit condition does not automatically make an entrant a winner.
Selection is based upon the overall judging criteria.
10. JUDGING CRITERIA
Eligible entries may be evaluated according to the following 100-point judging system:
A. Personal Story and Impact — 30 Points
How clearly and authentically the applicant explains his or her credit journey, current circumstances, challenges, and the effect those challenges have had on personal or financial goals.
B. Commitment to the Credit Comeback Process — 30 Points
The applicant's demonstrated willingness to:
- Actively participate;
- Follow the program requirements;
- Communicate with DIG;
- Maintain required SmartCredit access;
- Avoid new credit inquiries;
- Maintain positive payment behavior;
- Reduce revolving debt;
- Follow the established credit strategy; and
- Make responsible financial changes.
C. Purpose and Future Goals — 25 Points
How clearly the entrant describes meaningful goals that improving his or her credit profile may help support, including housing, transportation, financing, business, family, or other legitimate personal objectives.
D. Completeness, Authenticity and Communication — 15 Points
The overall completeness and authenticity of the entry and the applicant's ability to clearly communicate why he or she is prepared for the opportunity.
Maximum Score: 100 Points
DIG may utilize one or more individuals to evaluate eligible submissions.
All judging decisions made in good faith and according to the published criteria are final, subject to applicable law.
11. TIE-BREAKING PROCEDURE
If two or more entrants have identical or substantially identical scores for the final available winning position, the higher score in:
Commitment to the Credit Comeback Process
will be used as the first tie-breaker.
If a tie remains, the higher:
Personal Story and Impact
score will control.
If a tie still remains, the tied submissions may be reevaluated using the same published judging criteria.
A random drawing will not be used to resolve a tie.
12. FIVE POTENTIAL WINNERS
DIG intends to identify five (5) potential winners.
An individual whose name is announced is initially considered a potential winner.
Winner status becomes final only after:
- Eligibility has been verified;
- Identity has been verified;
- Age has been verified;
- Residency has been verified;
- DIG confirms that the entrant is not an excluded current or previous client;
- DIG confirms that the entrant is not an excluded employee or family member;
- DIG verifies compliance with the one-entry restriction;
- Required documents are provided;
- The prize is accepted;
- Required agreements are executed; and
- The individual satisfies the conditions necessary to begin the program.
13. WINNER NOTIFICATION AND ACCEPTANCE
Potential winners may be notified through the email address, telephone number, text-message number, or other contact information supplied with their entry.
A potential winner must respond to DIG's winner notification and begin the verification process within forty-eight (48) hours after notification is sent.
Failure to respond within the required period may result in forfeiture.
DIG is not responsible for:
- Incorrect contact information submitted by an entrant;
- Full email inboxes;
- Spam or junk-email filtering;
- Changed telephone numbers;
- Disabled telephone service; or
- An entrant's failure to review communications.
Entrants are responsible for maintaining accurate contact information.
14. ALTERNATE WINNERS
A potential winner may forfeit the opportunity if that individual:
- Is determined to be ineligible;
- Cannot be contacted;
- Fails to respond within the applicable deadline;
- Refuses the prize;
- Fails to provide required verification documents;
- Fails to execute required agreements;
- Provides false information; or
- Otherwise fails to satisfy these Official Rules.
In that event, DIG may select an alternate potential winner from the remaining eligible entries based upon the same published judging criteria.
DIG is not required to award a prize to an ineligible person.
15. PRIZE
Five (5) eligible winners will each receive qualifying Dunigan Investment Group credit-repair services with an Approximate Retail Value ("ARV") of $2,500 per winner.
ARV Per Winner: $2,500
Number of Winners: 5
Total Approximate Retail Value: $12,500
The prize consists of qualifying DIG credit-repair and credit-education services provided without DIG's normal service fee, subject to these Official Rules and the separate service agreement.
Services may include, as appropriate to the individual credit profile:
- Comprehensive credit-report review;
- Identification and analysis of potentially negative credit-report information;
- Personalized credit-improvement strategy;
- Credit-bureau dispute preparation and management where appropriate;
- Review of collections, late payments, charge-offs, inquiries, and other reporting;
- Credit education;
- Credit-building recommendations;
- Progress monitoring; and
- Strategy adjustments.
The exact services performed may vary based on the winner's individual credit profile.
16. NO CASH VALUE OR TRANSFER
The prize:
- Cannot be redeemed for cash;
- Cannot be sold;
- Cannot be transferred;
- Cannot be assigned to another person;
- Cannot be substituted for another DIG product or service at the winner's request;
- Cannot be indefinitely postponed;
- Cannot be transferred to a friend, spouse, family member, or business partner; and
- Cannot be combined with another promotion unless DIG agrees in writing.
If a winner becomes ineligible or is terminated from the program, the unused portion of the complimentary services has no cash surrender value.
17. SMARTCREDIT REQUIREMENT
No purchase or payment is necessary to enter or be judged in the Contest.
SmartCredit is not required merely to submit an entry.
However, if an entrant is selected, verified, accepts the prize, and begins the credit-repair program, maintaining an active SmartCredit membership becomes a mandatory condition of continued participation.
Each winner must maintain an active SmartCredit membership for the entire six-month participation period.
The SmartCredit membership is currently approximately:
$39.99 per month
and is the responsibility of the winner.
SmartCredit is a third-party service and its membership cost is not included in the $2,500 DIG prize value.
SmartCredit access allows DIG to review credit-report information, monitor reported changes, evaluate progress, and determine appropriate strategy.
Winners are responsible for:
- Maintaining an active membership;
- Maintaining a valid payment method;
- Maintaining accurate access credentials;
- Providing necessary access in the manner designated by DIG; and
- Promptly resolving interruptions to the account.
If SmartCredit becomes inactive, cancelled, inaccessible because of nonpayment, or otherwise unavailable because of the winner's failure to maintain the account, DIG may immediately suspend services.
Continued failure to maintain required SmartCredit access may result in termination from the program and forfeiture of all remaining complimentary services.
18. REQUIRED WINNER DOCUMENTATION
Before services begin, each verified winner must provide DIG with all reasonably required identity and address verification documents.
Required documentation includes:
- A clear copy of a valid government-issued driver's license or photo identification;
- A clear copy of the winner's Social Security card;
- A current utility bill bearing the winner's name and residential address and matching the address associated with the identification submitted; and
- Any additional documentation reasonably necessary to verify identity, address, or information within the winner's consumer credit files.
Documents must be provided through the secure method designated by DIG.
Winners should never submit Social Security cards or other sensitive documentation through public social-media posts or unsecured public channels.
Failure to provide satisfactory documentation may result in forfeiture of winner status or termination from the program.
19. SIX-MONTH PARTICIPATION COMMITMENT
The Dunigan 5 is intended to be an active credit-repair and credit-education process lasting up to approximately six months.
The six-month period does not guarantee:
- Completion of every possible dispute;
- Removal of any particular account;
- A particular credit score;
- A particular number of score points;
- Loan approval;
- Funding approval; or
- Any other specific result.
Continued complimentary participation is conditioned upon compliance with these Official Rules.
20. REQUIRED COMMUNICATION AND AVAILABILITY
Winners must remain reasonably available and responsive throughout the program.
Winners may be required to participate in:
- Telephone calls;
- Video calls;
- Credit-progress reviews;
- Credit-strategy discussions;
- Documentation requests;
- Account-information reviews;
- Follow-up conversations;
- Progress interviews; and
- Other reasonable communications related to the program.
Winners are responsible for keeping their:
- Email address;
- Mobile telephone number;
- Mailing address; and
- Other relevant contact information
current with DIG.
Repeated failure to respond, repeated failure to attend scheduled appointments without rescheduling, refusal to provide necessary information, or prolonged noncooperation may result in suspension or termination.
21. NO NEW CREDIT APPLICATIONS OR HARD INQUIRIES
During the six-month program, winners must not knowingly apply for new credit or knowingly authorize any new hard credit inquiry.
This prohibition includes applications for:
- Credit cards;
- Personal loans;
- Auto loans;
- Vehicle financing;
- Mortgages;
- Home-equity products;
- Retail or store credit;
- Lines of credit;
- Financing accounts;
- Business credit requiring use of the winner's personal credit;
- Consumer loans;
- Buy-now-pay-later products that result in a hard inquiry or new reported credit account; and
- Any other product or transaction reasonably expected to result in a new hard credit inquiry or new credit account.
Winners must not knowingly authorize a dealer, lender, broker, financial institution, or other third party to repeatedly submit their credit to multiple lenders.
The purpose of this rule is to maintain stability in the winner's credit profile while DIG is actively working with that profile.
A hard inquiry created without the winner's authorization, including one resulting from suspected identity theft or fraud, will not by itself constitute a violation provided the winner promptly informs DIG when reasonably possible.
Knowingly applying for new credit or knowingly generating prohibited inquiries may result in immediate suspension or termination from the program.
22. EXISTING CREDIT CARDS AND CREDIT UTILIZATION
Winners with existing revolving credit-card balances must actively work toward reducing those balances.
Within the first three months of participation, winners are expected to make reasonable and consistent efforts to reduce reported revolving utilization to below 30% of the applicable available credit limits.
For example: If a credit card has a $1,000 limit, the target reported balance should be less than $300.
Winners are expected to continue maintaining responsible utilization throughout the remainder of the program whenever financially possible.
Winners should not intentionally:
- Max out credit cards;
- Repeatedly approach credit limits;
- Increase balances unnecessarily; or
- Engage in conduct inconsistent with the credit strategy established during the program.
Nothing in these Official Rules requires a winner to miss payments on necessities or engage in financially unsafe behavior merely to meet a utilization target.
23. PAYMENT HISTORY AND EXISTING ACCOUNTS
Winners are responsible for keeping current financial obligations paid on time.
Accounts capable of reporting payment information to a consumer reporting agency should be paid on or before their required due dates.
This may include:
- Credit cards;
- Auto loans;
- Mortgages;
- Student loans;
- Personal loans;
- Installment accounts;
- Lines of credit;
- Retail accounts; and
- Other reporting obligations.
DIG cannot prevent a creditor or other furnisher from reporting legitimate new late payments or delinquencies arising from a winner's payment behavior.
Winners should avoid creating new:
- Late payments;
- Delinquencies;
- Charge-offs;
- Collections;
- Returned payments; or
- Other derogatory information.
Repeated or intentional failure to maintain existing obligations may materially interfere with the program and may result in termination.
24. PROMOTIONAL PARTICIPATION BY WINNERS
The Dunigan 5 is intended to document real credit-repair journeys and provide educational and promotional content concerning the participants' experiences.
As a condition of continued participation, winners agree to reasonably participate in campaign-related promotional activities throughout the six-month process.
Winners may be asked to:
- Share the official Dunigan 5 campaign link;
- Share approved campaign content;
- Discuss their experience;
- Participate in reasonable progress updates;
- Speak about actual changes occurring during the process;
- Participate in interviews;
- Participate in video content;
- Participate in social-media content;
- Participate in before-and-after progress discussions where appropriate; and
- Help promote awareness of The Dunigan 5 campaign during their participation period.
Winners are expected to periodically share and discuss the campaign throughout their participation rather than only at the beginning or conclusion of the program.
Reasonable scheduling accommodations may be made when practical.
25. TESTIMONIALS MUST BE TRUTHFUL
DIG will not require a winner to make a statement that is false or to claim that a result occurred when it did not.
Any testimonial, review, video, social-media statement, or public description of results must reflect the winner's actual experience and genuine opinion.
Because winners receive DIG services without DIG's normal service charge, winners who publicly endorse, review, recommend, promote, or discuss DIG in promotional content must clearly disclose that relationship.
The disclosure should be clear and reasonably noticeable in connection with the endorsement.
26. PUBLICITY AND DOCUMENTATION OF WINNER JOURNEY
Subject to applicable law, winners agree that DIG may document portions of their participation in The Dunigan 5.
This may include use of:
- First name and/or approved identifying information;
- Photographs;
- Video footage;
- Interviews;
- Voice recordings;
- Progress updates;
- Testimonials;
- Statements regarding the winner's experience; and
- Non-sensitive credit-related progress information expressly authorized for public disclosure.
DIG will not knowingly publicly disclose a winner's:
- Social Security number;
- Full credit-report account number;
- Password;
- SmartCredit password;
- Full financial-account number; or
- Other highly sensitive authentication information.
Any public representation of results must be truthful and should not imply that the same results are guaranteed for other consumers.
27. COOPERATION WITH THE PROGRAM
Winners must reasonably cooperate with the credit-repair strategy and administration of the program.
Prohibited conduct includes:
- Knowingly providing false information;
- Concealing material information necessary to administer the services;
- Repeatedly refusing reasonable communications;
- Knowingly generating prohibited new hard inquiries;
- Knowingly opening prohibited new accounts;
- Repeatedly creating new derogatory payment information;
- Failing to maintain required SmartCredit access;
- Sharing DIG access credentials or proprietary materials without authorization;
- Fraud;
- Abuse of the program; or
- Intentional conduct that materially interferes with DIG's ability to provide the complimentary services.
28. REMOVAL OR TERMINATION FROM THE PROGRAM
DIG may suspend or terminate a winner's complimentary participation for material violation of these Official Rules.
Grounds may include:
- Failure to maintain SmartCredit;
- Failure to provide required identification;
- Failure to provide required verification documentation;
- Fraud or material misrepresentation;
- Repeated noncommunication;
- Repeated failure to participate in necessary calls;
- Knowingly applying for prohibited new credit;
- Knowingly generating prohibited hard inquiries;
- Material interference with the credit-repair process;
- Refusal to comply with reasonable participation requirements;
- Failure to participate in required campaign-related promotional activities;
- Abuse of the program; or
- Material violation of another provision of these Official Rules.
Termination means DIG's obligation to provide the remaining complimentary services ends.
A terminated winner is not entitled to:
- Cash;
- A refund for the unused prize value;
- Replacement services;
- An extension;
- Transfer of the prize;
- Future complimentary service; or
- A substitute prize.
29. NO GUARANTEE OF CREDIT RESULTS
DIG does not guarantee the removal of accurate, current, and verifiable information from a consumer credit report.
Participation in The Dunigan 5 does not guarantee:
- Removal of any particular item;
- Removal of a particular number of items;
- A specific credit score;
- A specific credit-score increase;
- A specific number of points;
- Mortgage approval;
- Auto-loan approval;
- Credit-card approval;
- Personal funding;
- Business funding;
- A particular credit limit;
- A particular interest rate;
- Approval from any lender; or
- Any other financial outcome.
Individual results vary significantly.
Results may depend upon numerous factors outside DIG's control, including:
- Information contained in a consumer's credit files;
- Responses from consumer reporting agencies;
- Responses from furnishers;
- The accuracy and verifiability of reported information;
- Existing balances;
- Utilization;
- Payment history;
- New activity;
- Identity issues;
- Creditor practices;
- The winner's financial behavior; and
- The winner's compliance with the program.
30. CREDIT-REPAIR AGREEMENT AND CONSUMER RIGHTS
Selection as a winner does not eliminate or replace any consumer rights provided under applicable federal or state law.
Before credit-repair services begin, winners may be required to execute DIG's separate credit-repair service agreement and receive any disclosures, notices, cancellation rights, and other documentation required by applicable law.
These Official Rules govern the Contest and conditions attached to the complimentary prize.
They are not intended to replace the legally required credit-repair service agreement or consumer disclosures.
If an applicable law provides a consumer with a nonwaivable right, nothing in these Official Rules is intended to eliminate that right.
31. PRIVACY AND PERSONAL INFORMATION
Information submitted by entrants may be used to:
- Administer the Contest;
- Evaluate entries;
- Communicate with entrants;
- Verify eligibility;
- Contact potential winners;
- Prevent duplicate or fraudulent entries;
- Administer the winner program;
- Provide information requested by the entrant;
- Maintain business records;
- Carry out uses expressly authorized through the entry and media-consent process; and
- Conduct communications permitted under these Official Rules and applicable law.
Sensitive winner documentation should be handled through DIG's designated secure collection process.
Entrants should not transmit sensitive information through public posts or entry videos.
The permission granted for public use of an entry video does not constitute permission for DIG to publicly disclose Social Security cards, passwords, financial-account information, SmartCredit credentials, identification documents, or other sensitive authentication information.
The collection and use of personal information may also be subject to the Dunigan Investment Group Privacy Policy made available through the Contest website.
32. FUTURE COMMUNICATIONS AND MARKETING
By submitting an entry to The Dunigan 5 Credit Comeback Giveaway, entrants understand that Dunigan Investment Group may continue communicating with entrants after the Contest has concluded, including individuals who are not selected as winners.
An individual does not have to be selected as one of The Dunigan 5 to receive future communications from Dunigan Investment Group where such communications are permitted by applicable law.
Future communications may include information concerning:
- Credit-repair education;
- Credit-building information;
- Credit tips and strategies;
- Credit-report education;
- Financial-education content;
- Credit utilization tips;
- Credit-management strategies;
- New educational content;
- Future Dunigan Investment Group promotions;
- Future giveaways or contests;
- Special offers;
- Discounts;
- New products or services;
- Credit-related programs;
- Educational programs;
- Events;
- Webinars;
- Company announcements;
- Newsletters;
- Invitations;
- Resources;
- Business updates; and
- Other information concerning Dunigan Investment Group and its products or services.
The fact that an entrant is not selected as a winner does not automatically remove that individual from communications for which DIG otherwise has lawful permission to contact the individual.
33. CONTEST-RELATED COMMUNICATIONS
By entering the Contest and voluntarily providing contact information, entrants authorize DIG to contact them as reasonably necessary to administer The Dunigan 5.
Contest-related communications may include:
- Entry confirmations;
- Application questions;
- Requests concerning video submissions;
- Eligibility questions;
- Contest updates;
- Deadline reminders;
- Potential-winner notifications;
- Winner verification requests;
- Documentation requests;
- Program-related information; and
- Other communications reasonably necessary to administer the Contest.
Contest-administration communications are separate from optional promotional text-message marketing consent.
34. FUTURE EMAIL COMMUNICATIONS
By providing an email address in connection with the Contest, entrants understand that DIG may use the email address for Contest-related communications and, where permitted by applicable law, future educational, informational, and promotional email communications.
Future emails may include:
- Credit tips;
- Credit-repair education;
- Credit-building information;
- Financial-education materials;
- Newsletters;
- Future contests;
- Promotions;
- Special offers;
- DIG service information;
- Event invitations;
- Educational opportunities; and
- Other business communications.
Promotional email communications will provide recipients with an appropriate method for unsubscribing or opting out of future promotional emails.
An entrant may unsubscribe from promotional emails without cancelling an otherwise valid Contest entry.
35. PROMOTIONAL TEXT MESSAGES AND TELEPHONE COMMUNICATIONS
DIG may provide entrants with an opportunity to separately consent to future promotional or educational text messages, automated calls, prerecorded messages, or similar communications at the telephone number provided.
Where separate affirmative consent is required by applicable law, such consent will be collected separately from the Contest entry and Official Rules acknowledgment.
Potential promotional text communications may include:
- Credit tips;
- Credit-repair education;
- Credit-building information;
- Future giveaways;
- Special promotions;
- Offers;
- Discounts;
- Educational events;
- DIG products or services;
- Company announcements; and
- Other promotional or informational content.
Message frequency may vary.
Message and data rates may apply.
Individuals who separately consent to promotional text messages may later withdraw that consent through methods permitted by applicable law, including applicable keyword-based opt-out requests such as STOP.
DIG will honor valid opt-out requests as required by applicable law.
36. NO EFFECT ON CONTEST ENTRY
An entrant's decision to:
- Decline optional promotional text-message consent;
- Decline optional automated marketing-call consent;
- Unsubscribe from promotional email communications;
- Withdraw previously granted promotional marketing consent; or
- Opt out of future marketing communications
will not invalidate an otherwise valid Contest entry.
Opting out of promotional communications will not, by itself:
- Disqualify an entrant;
- Reduce an entrant's judging score;
- Affect the entrant's chances of selection;
- Cause an eligible entrant to lose winner status; or
- Affect the continued provision of prize services if the individual is otherwise complying with the winner participation requirements.
Entrants may still receive communications reasonably necessary to administer their Contest entry, verify eligibility, provide requested services, administer an existing relationship, comply with legal obligations, or complete transactions initiated by the individual.
37. MARKETING OPT-OUT
Recipients may opt out of promotional communications through the methods provided with the applicable communication.
Depending upon the communication channel, available methods may include:
- An email unsubscribe link;
- Replying STOP to promotional text messages;
- Following instructions included within the communication;
- Contacting DIG through an available business contact method; or
- Another reasonable opt-out method recognized by applicable law.
Opting out of one communication channel may not automatically opt the individual out of every other communication channel unless the request clearly asks DIG to stop communications across all channels.
DIG will process valid opt-out requests in accordance with applicable law.
38. TAXES AND PERSONAL EXPENSES
Any federal, state, local, or other taxes arising from acceptance of a prize are the responsibility of the winner to the extent required by law.
DIG may request information or documentation required for lawful tax reporting.
Except for the DIG services specifically included in the prize, winners are responsible for their own incidental expenses, including the required SmartCredit membership.
39. TECHNICAL FAILURES
DIG is not responsible for entries that are lost, late, incomplete, corrupted, misdirected, inaccessible, or not received because of circumstances beyond DIG's reasonable control, including:
- Internet outages;
- Server failures;
- Website malfunctions;
- Upload failures;
- Device malfunctions;
- Email-delivery failures;
- Telecommunications failures; or
- Similar technical problems.
If DIG determines that a technical problem materially interfered with administration of the Contest, DIG may take reasonable corrective action consistent with applicable law and fairness to entrants.
40. FRAUD AND INTERFERENCE
Any attempt to deliberately damage the Contest website, manipulate the judging process, falsify an entry, impersonate another person, use automated entry technology, or otherwise interfere with the legitimate administration of the Contest may result in disqualification and any other remedies available under applicable law.
DIG reserves the right to verify information submitted by entrants.
41. RIGHT TO MODIFY, SUSPEND OR CANCEL
To the extent permitted by applicable law, DIG may suspend, modify, extend, or cancel the Contest if circumstances outside its reasonable control materially impair the integrity, security, administration, or lawful operation of the Contest.
Such circumstances may include:
- Fraud;
- Significant technical malfunction;
- Cyberattack;
- Natural disaster;
- Government action;
- Legal or regulatory requirement;
- Platform outage;
- Force majeure; or
- Other circumstances making fair administration impracticable.
DIG will not use this provision to arbitrarily change the judging rules after reviewing entries or to improperly deprive a properly selected winner of a prize.
42. SOCIAL-MEDIA DISCLAIMER
The Dunigan 5 Credit Comeback Giveaway may be promoted or discussed on Facebook, Instagram, TikTok, YouTube, or other social-media platforms.
Unless expressly stated otherwise, this Contest is not sponsored, endorsed, administered by, or associated with those platforms.
Questions regarding the Contest should be directed to Dunigan Investment Group rather than the applicable social-media platform.
43. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, DIG will not be liable for indirect, incidental, consequential, special, or punitive damages arising solely from participation in the Contest or acceptance of the complimentary prize, except where liability cannot legally be waived or limited.
Nothing in these Official Rules is intended to waive a right or remedy that applicable law does not permit the entrant or winner to waive.
44. GOVERNING LAW
Except where prohibited by applicable law, these Official Rules and disputes specifically concerning administration of the Contest will be interpreted under applicable federal law and the laws of the State of Florida, without regard to conflict-of-law principles.
Nothing in this provision deprives an entrant of consumer protections that applicable law makes nonwaivable.
45. SEVERABILITY
If any provision of these Official Rules is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
An invalid provision should be interpreted or limited as necessary to make it enforceable where legally permitted.
46. NO WAIVER
DIG's failure to enforce a provision of these Official Rules on one occasion does not constitute a permanent waiver of that provision or DIG's right to enforce it later.
47. FINALITY OF JUDGING
Subject to applicable law, all eligibility determinations, judging scores, tie-breaking determinations, and decisions concerning compliance with these Official Rules are final when made in good faith according to the stated rules.
DIG may not arbitrarily disqualify an otherwise eligible entrant or change the published judging criteria merely to favor a particular applicant.
